The court in the case observed and has held that the matters which are settled through earlier Public Interest Litigations, PIL cannot be re-agitated through fresh proceedings, even by different petitioners, especially after significant delay.
The court in the case acknowledged that while the earlier writ petitions were filed by different persons, they were instituted as public interest litigations, PIL. Though these judgments technically did not create a legal bar for the current petitioner.
