Kerala High Court: Challenge to nine-year-old appointment through new petitioners not possible if earlier petitions were dismissed for delay

The Kerala High Court in the case observed and has dismissed the writ appeal filed challenging the order of single judge wherein the court directed fresh consideration of representations against a professor's appointment.

The Division bench comprising of Justice Anil K. Narendran and Justice P.G. Ajithkumar was hearing the present matter.

The court in the case observed and has held that the matters which are settled through earlier Public Interest Litigations, PIL cannot be re-agitated through fresh proceedings, even by different petitioners, especially after significant delay.

The court in the case acknowledged that while the earlier writ petitions were filed by different persons, they were instituted as public interest litigations, PIL. Though these judgments technically did not create a legal bar for the current petitioner.
