Justice in Sri Lanka is notoriously slow, and its reform equally so

The rule of law depends not just on judges, but on an entire ecosystem including police, lawyers and prisons. Updated laws and regulations for civil, criminal and commercial are also required for justice to be done. Of course, trials are getting fairer and the basic rights of defendants, like the presumption of innocence and provision of a defence lawyer, have been tenets of the justice system for a long time.

However, the chronic delays and outdated laws, are reasons for the inability of the justice system to keep up with the demands of a modern economy and a transforming society.

Sri Lanka’s fight against corruption has also faltered, due in part to its inability to bring to justice those responsible. Politicians, even when they are brought to trial for corruption, remain untouchable by the justice system. The weakness of the rule of law has a direct consequence on the country’s investment climate too. Serious investors, the type who will fund world-class firms, overwhelmingly prefer the rule of law, efficient judicial infrastructure and up-to-date laws suitable for modern commerce. Sri Lanka's judicial system is a discussion of a roundtable titled ‘Future-proofing Sri Lanka’s legal system’ starting on page 88.
