A COUNCIL has lost a case brought against them by a furious driver who claimed the signage on a “money trap” bus gate was “woefully inadequate”.
Ian McAteer's victory over Glasgow City Council came after winning an appeal against a fine for driving through the restricted lane in Cathedral Street.
Ian, 66, claims his case could see hundreds of other motorists launching a legal challenge and fighting their penalty charge notices.
After a tribunal judge agreed the bus gate signage is “inadequate”, Ian said: “The council has been raking in millions of pounds from a bus gate that has now been judged to be unlawful.
“The bus gate at Cathedral Street has been there for many years and it has been raking in a lot of money for the council.
“In 2017, a figure of £1.2million was reported. More recently it was catching 13 drivers a day, which might be as much as £300,000 a year. It ranks fourth in Glasgow for getting the most money.
“It's been a lucrative money trap for the council but now I've won my appeal, they will have to change the signage to make it clear and fair to drivers.”
Drivers caught by enforcement cameras driving through bus gates in Glasgow are issued with a £60 penalty, reduced to £30 if paid within 14 days. The fines rise to £90 if unpaid within 28 days.
