Insolvency and Bankruptcy Code (IBC) was enacted on May 2016. In August 2021, the Parliamentary Committee on Finance examined the IBCâs performance and expressed serious concerns about low recoveries and huge haircuts creditors took (even 90-95% haircuts in some cases), apart from long delays in disposal of cases.
According to IBBI (Insolvency and Bankruptcy Board of India), the haircut (or loss of debt) is 90% in Q4 FY22. In Q3 FY22 the haircut was 86.6%. There is ample evidence to show that the IBC has proved to be a disaster â far worse than the BIFR which was replaced.
