Judgement on govt employees' entitlement to increment earned a day before retirement: Supreme Court clarifies date of application

The Supreme Court in the case observed and has passed an interim order making certain important clarifications with regards to the application of its judgment in the case The Director (Admn and HR) KPTCL & Others vs CP Mundinamani and others, wherein the court held that government employees are entitled to the increment which they earned on the previous day of their retirement.

On April 11, 2023, the twojudge bench delivered the judgement.

On September 6, the another two-judge bench comprising Justice Sanjiv Khanna and Justice Sanjay Kumar, while, acting on certain miscellaneous applications seeking clarifications, passed the following directions.

1.The Judgement dated April 11, 2023, will be given effect to in case of third parties which being from the date of the judgment, that is, the pension by taking into account one increment will be payable on and after May 01, 2023.
