The Los Angeles county district attorney has recommended that Eric and Lyle Menendez should be resentenced and released on parole.
The move comes after the notorious case was featured in a documentary and drama miniseries on Netflix.
It provided new evidence of physical and sexual abuse by their dad and gave fresh context to the killings.
That has prompted district attorney George Gascón to recommend that Erik, 53, and Lyle, 56, be re-sentenced since the further evidence reportedly merits a review.
The 1989 shootings of their parents Jose and Kitty in their Beverly Hills mansion have gripped the US for decades amid claims of a possible miscarriage of justice.
For the brothers to gain their freedom, a judge would have to agree with the recommendation before a parole board approved their release.
Erik and Lyle are currently serving life in jail without the possibility of parole, in California.
