A panel of Supreme Court judges yesterday said existing laws do not prevent the Manchester Ship Canal Company from making a claim for damages over unauthorised discharges of waste.
It comes after a six-year legal battle between the private company -owned by the Peel Group - and United Utilities.
In 2021, the High Court held that the company was protected under the 1991 Water Companies Act from being sued unless the discharges are proved to be deliberate or negligent.
