<p><strong>WRONGLY jailed Andy Malkinson was &ldquo;utterly failed&rdquo; by the body that should have reinvestigated his case, his solicitor said yesterday.&nbsp;</strong></p>
<p>The Criminal Cases Review Commission allegedly failed to act after another man&rsquo;s DNA was found in 2007 on the clothes of the woman he was mistakenly convicted of raping.</p>
<p>It meant Mr Malkinson &ndash; who spent 17 years in jail for a crime he did not commit &ndash; could have been freed 13 years earlier.</p>
<p>His solicitor Emily Bolton said it was &ldquo;a shocking chronicle of how Andy was utterly failed by&nbsp;the body which should have put an end to his wrongful conviction nightmare, but instead acted as a barrier to justice. An over&nbsp;haul of the CCRC is needed to prevent it failing other innocent prisoners.&rdquo;</p>

<p>Mr Malkinson, 57, was convicted of raping a woman in Manchester&nbsp;in 2003 and jailed for life in 2004 with a minimum term of seven&nbsp;years. But he served a further 10 for maintaining his innocence.</p>
<p>He was released in 2020 but remained on licence as a registered sex offender until his conviction&nbsp;was quashed last month at the Court of Appeal.</p>
