WINKING at a female worker can be classed as sexual harassment, a tribunal has ruled.The judgment came in the case of waitress Jenna Almussawi, who was awarded £41,535 after her treatment at the hands of restaurant boss Wejdi Moussa.Mr Moussa "singled out" Ms Almussawi and subjected her to a campaign of harassment - including repeatedly winking at her - which left her "worried and scared".She complained to colleagues about his behaviour, which included him telling her she had the "prettiest eyes he had ever seen", but he overheard her on CCTV.In retaliation, he stopped her shifts and she was effectively dismissed.An employment tribunal has condemned his behaviour and said the winking amounted to harassment and was "clearly unwanted" conduct.Ms Almussawi alleged sexual harassment and unfair dismissal at the Glasgow hearing after her experience working at the Mailcoach restaurant in Uddingston, Lanarks.Employment Judge Peter O'Donnell said Mr Moussa's conduct was related to Ms Almussawi's sex, or was of a sexual nature. Her claim of unfair dismissal was not upheld as she had not completed two years of service.
