New Delhi: Observing that the artificial distinction between married and single women in case of terminating unwanted pregnancies is not constitutionally sustainable, the Supreme Court on Thursday ruled that every pregnant woman, irrespective of marital status, has the right to choose to undergo abortion under the Medical Termination of Pregnancy (MTP) Act, without undue interference from the State, or consent or authorisation from a third party.
A woman’s right will be under attack if she is forced to continue with an unwanted pregnancy, the SC said. Section 3(2)(b) of the Act permits termination of a pregnancy from 20 to 24 weeks, but is silent in case of single women.
In an important verdict to further strengthen the reproductive rights of women, a bench of Justices D Y Chandrachud, A S Bopanna and J B Pardiwala of the Supreme Court said on Thursday that both married and single women are now allowed to decide on undergoing abortion of unwanted pregnancy under the Medical Termination of Pregnancy MTP) Act and rules made under the law.
