THE jury in the trial of 37-year-old Luke Dann, accused of murdering David Kelly by running him over in a city lane, have been told they have heard all the evidence in the case after his defence barrister urged them to clear him of all charges.
Dann, from Beechwood Rise, Manor Park, pleaded not guilty to the charge of murder as well as not guilty to the alternative charge of manslaughter. In the latter stages of the trial, which began on Monday, they were told there would be a further charge of death by dangerous driving for them to consider.
The 37-year-old city businessman is accused of killing 42-year-old David Kelly on the evening of March 21 this year by intentionally driving his large black Range Rover at and over him in Leigham Manor Drive.
The jury were told that patterned injuries to the left side of Mr Kelly’s face suggests the wheel of the car went off over his face, crushing his skull against the road.
Following the end of the prosecution case, Dann’s defence team told Judge Peter Johnson their client would not enter the witness box and they would offer no other evidence.
