ഒരമ്മയ്ക്ക് അഞ്ചു മക്കളുണ്ടെങ്കിൽ, ആ അഞ്ചു പേരെയും അമ്മ ഒരു പോലെ മാത്രമേ സ്നേഹിക്കാവൂ. ഏറ്റക്കുറച്ചിൽ പാടില്ല. ഒരാളെ ചെറുതായൊന്ന് നുള്ളി നോവിച്ചാൽ പോലും ആ കുഞ്ഞിന്റെയുള്ളിൽ അത് വല്ലാത്ത നീറ്റലുണ്ടാക്കും. രാജ്യത്തെ പൗരത്വ (ഭേദഗതി) നിയമം (സി.എ.എ) അതിന് സമാനമാണെന്നാണ് ലളിതമായി പറയാനുദ്ദേശിച്ചത്. രാജ്യത്തെ ഭരണാധികാരികൾ ജനങ്ങളെ ഒന്നിപ്പിക്കാനാണ് മറിച്ച് ഭിന്നിപ്പിക്കാനല്ല ശ്രമിക്കേണ്ടത്. എല്ലാവരെയും ഉൾക്കൊണ്ടു വേണം ജനനന്മയ്ക്കായുള്ള ഓരോ ഭരണപരിഷ്ക്കാരങ്ങളും രാജ്യം നടപ്പിലാക്കേ ണ്ടത്. അറിഞ്ഞോ, അറിയാതെയോ ഒരു വിഭാഗങ്ങളെയും തഴഞ്ഞുകൂടാ. മുസ്ലീം ജനവിഭാഗങ്ങൾക്കുള്ള സംശയം ദൂരീകരിക്കാനും അവരുടെ ആശങ്കകൾ അകറ്റുവാനും രാജ്യം തയ്യാറാകേണ്ടതുണ്ട്. കേരളത്തിൽ ഈ നിയമം നടപ്പിലാക്കില്ലെന്ന് നമ്മുടെ മുഖ്യമന്ത്രി ആവർത്തിച്ചു പറയുന്നുമുണ്ട്. ഭരണഘടനാ പ്രകാരം അതിന് സാധിക്കില്ലെന്നത് വേറെ കാര്യം. 31.12.2014-നോ അതിനുമുമ്പോ ഇന്ത്യയിൽ പ്രവേശിച്ച പാകിസ്ഥാൻ, ബംഗ്ലാദേശ്, അഫ്ഗാനിസ്ഥാൻ എന്നിവിടങ്ങളിൽ നിന്നുള്ള ഹിന്ദു,സിഖ്, ബുദ്ധ, ജൈന, പാഴ്സി, ക്രിസ്ത്യൻ സമുദാ യങ്ങളിൽപ്പെട്ട കുടിയേറ്റക്കാർക്ക് പൗരത്വം നൽകാൻ ലക്ഷ്യമിട്ടുള്ളതാണ് നിലവിലെ പൗരത്വ (ഭേദഗതി) നിയമം. മതാടിഷ്ഠിത പൗരത്വ നിയമ ഭേദഗതികൾ 2019 ലാണ് പാർലമെന്റ് പാസാക്കിയത്. 12.12.2019-ന് രാഷ്ട പതിയുടെ അംഗീകാരത്തോടെ വിജ്ഞാപനം ചെയ്ത് പ്രാബല്യത്തിൽ വരുത്തി. പാർലമെന്റ് തെരഞ്ഞെടുപ്പിന് മുന്നോടിയായി രാജ്യത്ത് എമ്പാടും ഇപ്പോൾ സി.എ.എ ചട്ടം നിലവിൽ വരികയാണ്. പൗരത്വ (ഭേദഗതി) നിയമ ത്തിനെതിരെയും (സി.എ.എ), ദേശീയ ജനസംഖ്യാ രജിസ്റ്റർ (എൻ.പി.ആർ), ദേശീയ പൗരത്വ രജിസ്റ്റർ (എൻ.ആർ.സി) എന്നിവ നടപ്പാക്കുന്നതിനെതിരെയും ഇന്ത്യയിൽ പ്രതിഷേധങ്ങളുടെ ഒരു പരമ്പര തന്നെയാണ് നടന്നത്? ദേശീയ പൗരത്വ രജിസ്റ്ററിൽ മുസ്ലീങ്ങൾക്ക് ഇന്ത്യൻ പൗരത്വം നഷ്ടപ്പെടുമെന്ന ആശങ്കയാണ് അതിന് വഴിവെച്ചത്. എന്നാൽ മേൽ പ്രസ്താവിച്ച ഇസ്ലാമിക രാജ്യങ്ങളിൽ നിന്ന് ഇന്ത്യയിലേക്ക് കുടിയേറിയിട്ടുള്ള പീഢിതമതന്യൂനപക്ഷങ്ങൾക്ക് പൗരത്വം നൽകുന്നതിനുള്ളതാണ്, രാജ്യത്തെ പൗരന്മാരുടെ പൗരത്വം എടുത്തുകളയാനുള്ളതല്ല ചട്ടങ്ങളും വ്യവസ്ഥകളും എന്നാണ് കേന്ദ്ര വിശദീകരണം. രാജ്യമൊട്ടാകെ ഈ നിയമം നടപ്പിലാക്കരുതെന്നാവശ്യപ്പെട്ട് സർക്കാരിനെതിരെ 2020 ജനുവരി 12 വരെ ജനം തെരുവിൽ പ്രതിഷേധം നടത്തിയത് സമാനതകളില്ലാത്ത കാഴ്ചകളായിരുന്നു. കോവിഡ് -19ന്റെ കടന്നുവരവോടെയാണ് പ്രതിഷേധക്കാർ പിന്തിരിയാൻ നിർബന്ധിതരായത്.
2019 ഡിസംബർ 10-ന് പൗരത്വ (ഭേദഗതി) ബിൽ 80-ന് എതിരെ 311 വോട്ടുകൾക്കാണ് ലോക് സഭ പാ സ്സാക്കിയത്. തൊട്ടടുത്ത ദിവസം ഡിസംബർ 11 ന് 99 -നെതിരെ 125 വോട്ടുകൾക്ക് ബിൽ രാജ്യസഭയും പാസ്സാക്കി. ഡിസംബർ 12-ന് ബില്ലിൽ അന്നത്തെ രാഷ്ട്രപതി രാംനാഥ് കോവിന്ദ് ഒപ്പുവെച്ചു. അന്നു തന്നെ മുസ്ലീം ലീഗ് അതിനെതിരെ സുപ്രീം കോടതിയിൽ റിട്ട് ഹർജി നൽകിയിരുന്നു. ഇപ്പോൾ 4 വർഷങ്ങൾക്കിപ്പുറം 2024 മാർച്ച് 11-ന് പൗരത്വ നിയമ വ്യവസ്ഥകൾ നടപ്പാക്കുന്നതിനുള്ള ചട്ടങ്ങൾ വിജ്ഞാപനം ചെയ്തിരിക്കുകയാണ്.
മതം, ജാതി, വംശം എന്നിവയുടെ കാര്യത്തിൽ വിവേചനം പാടില്ലെന്ന ഭരണഘടനാ വ്യവസ്ഥയ്ക്ക് വിരുദ്ധമായ ഭേദഗതി നടപ്പാക്കാനുള്ള ബാദ്ധ്യത സംസ്ഥാനത്തിനില്ല എന്നും ഇക്കാര്യത്തിൽ അവസാന തീരുമാനം പറയേണ്ടത് സുപ്രീംകോടതിയാണ് എന്നും നമ്മുടെ നിയമ മന്ത്രി പി. രാജീവ് പറയുന്നു. തുല്യതയ്ക്കുള്ള അവകാശം നിഷേധിക്കുന്നതും വിവേചനവും മതനിരപേക്ഷത ഉറപ്പാക്കാത്തതും ചൂണ്ടിക്കാട്ടിയാണ് പൗരത്വ (ഭേദഗതി) നിയമം ഭരണഘടനാവിരുദ്ധമെന്ന് പ്രഖ്യാപിക്കണമെന്ന ആവശ്യം കേരളം ഉന്നയിക്കുന്നത്. ഭേദഗതി അടിയന്തരമായി റദ്ദാക്കണമെന്നും സംസ്ഥാനം വാദിക്കുന്നു. ഇന്ത്യൻ മുസ്ലിംകളുടെ സ്വാതന്ത്യവും അവസരങ്ങളും പൗരത്വ ഭേദഗതി നിയമം(സി.എ.എ) ഹനിക്കുന്നില്ലെന്നാണ് കേന്ദ്ര സർക്കാർ ആവർത്തിക്കുന്നത്. ലോകത്ത് എവിടെയുമുള്ള മുസ്ലിംകൾക്ക് ഇന്ത്യൻ പൗരത്വം തേടുന്നതിന് യാതൊരു തടസവുമില്ലെന്നും കേന്ദ്ര ആഭ്യന്തര മന്ത്രാലയം അറിയിക്കുന്നു. പൗരത്വ നിയമത്തിലെ സെക്ഷൻ 6 പ്രകാരം ലോകത്തെവിടെയുമുള്ള മുസ്ലിംകൾക്ക് ഇന്ത്യൻ പൗരത്വം തേടാം. പൗരത്വ നിയമങ്ങൾ സി.എ.എ. മൂലം റദ്ദാക്കപ്പെടുന്നില്ല. നിലവിൽ രാജ്യത്തുള്ള 18 കോടി ഇന്ത്യൻ മുസ്ലിംകൾക്ക് അതു കൊണ്ടു തന്നെ ആശകയ്ക്കു കാരണമൊന്നുമില്ല എന്നും കേന്ദ്ര സർക്കാർ പറയുന്നു. 2014 ഡിസംബർ 31 ന് മുമ്പ് ഇന്ത്യയിലെത്തിയ പാകിസ്താൻ, ബംഗ്ലാദേശ്, അഫ്ഗാനിസ്ഥാൻ&nbsp;എന്നിവിടങ്ങളിൽ നിന്നുള്ള രേഖകളില്ലാത്ത മുസ്ലിം ഇതര കുടിയേറ്റക്കാർക്ക് പൗരത്വത്തിനുള്ള അപേക്ഷയുടെ യോഗ്യതാ കാലയളവ് 11-ൽനിന്ന് 5 വർഷമായി കുറയ്ക്കുന്നതിനുള്ള നിയമമാണു നടപ്പാക്കുന്നത് എന്നാണ് പറയപ്പെടുന്നത്.
ഇന്ത്യയിലെ പൗരത്വം: ഒരു പരമാധികാര രാഷ്ട്രത്തിന്റെ നിയമപരമായ അംഗമായി അഥവാ ഒരു രാഷ്ട്രത്തിൽ ഉൾപ്പെട്ടതായി നിയ മപ്രകാരം അംഗീകരിക്കപ്പെട്ട വ്യക്തിയുടെ പദവിയാണ് പൗരത്വം. ഇന്ത്യയിൽ, ഭരണഘടനയുടെ ആർട്ടിക്കിൾ 5 മുതൽ 11 വരെ പൗരത്വ സങ്കൽപ്പത്തെക്കുറിച്ച് പ്രതിപാദിക്കുന്നു. 1955 ലെ പൗരത്വ നിയമം അനുസരിച്ച് പൗരത്വം നേടുന്നതിന് അഞ്ച് വഴികളുണ്ട്. ജന്മനായുള്ള പൗരത്വം,വംശജരായ പൗരത്വം,രജിസ്ട്രേഷൻ വഴിയുള്ള പൗരത്വം, പ്രകൃതിവൽക്കരണത്തിലൂടെയുള്ള പൗരത്വം, കൂടാതെ പ്രദേശം സംയോജിപ്പിച്ച് പൗരത്വം.1955 ലെ പൗരത്വ നിയമം, ആർട്ടിക്കിൾ 11(എ), (ബി) എന്നിവ പ്രകാരം പൗരത്വം അവസാനിപ്പിക്കുന്നതിനെ കുറിച്ചും പ്രതിപാദിക്കുന്നു. ചില വ്യവസ്ഥകൾക്ക് വിധേയമായി നമ്മുടെ രാജ്യം ഇരട്ട പൗരത്വം നൽകുന്നില്ലെന്ന് ആർ ട്ടിക്കിൾ 9 വ്യക്തമാക്കുന്നു. ആർട്ടിക്കിൾ 11-ൽ പൗരത്വത്തിനുളള അവകാശം നിയമപ്രകാരം നിയന്ത്രിക്കാൻ പാർലമെന്റിനാണ് അധികാരമെന്ന് പറയുന്നു. പൗരത്വം&nbsp; ഏറ്റെടുക്കുന്നതും അവസാനിപ്പിക്കുന്നതും സംബന്ധിച്ചും പൗരത്വവുമായി ബന്ധപ്പെട്ട മറ്റേതെങ്കിലും കാര്യത്തിലും എന്തെങ്കിലും വ്യവസ്ഥകൾ ഉണ്ടാക്കുന്നതിനും പാർലമെന്റിന് അവകാശമുണ്ടെന്നും പറയുന്നു.
പൗരത്വത്തെക്കുറിച്ചുള്ള വ്യവസ്ഥകൾ:
&nbsp;ഭരണഘടനയുടെ ആർട്ടിക്കിൾ 5-11 (ഭാഗം II) പ്രകാ രമാണ് ഇന്ത്യയിലെ പൗരത്വം നിയന്ത്രിക്കുന്നത്. 1955-ലെ പൗരത്വ നിയമം പൗരത്വവുമായി ബന്ധപ്പെട്ട നിയമനിർമ്മാണമാണ്. ഇത് പൗരത്വ (ഭേദഗതി) നിയമം 1986, പൗരത്വ (ഭേദഗതി) നി യമം 1992, പൗരത്വ (ഭേദഗതി) നിയമം 2003, പൗരത്വ (ഭേദ ഗതി) നിയമം, 2005 എന്നിവയാൽ ഭേദഗതി ചെയ്തിട്ടുണ്ട്. ഇന്ത്യയിലെ ദേശീയത കൂടുതലും പിന്തുടരുന്നത് ജസ് സാങ്ഗിനിസ് (രക്തത്തിന്റെ അവകാശം പ്രകാരമുള്ള പൗരത്വം) ആണ്. അല്ലാതെ സോളി (പ്രദേശത്തിനുള്ളിലെ&nbsp; ജനന അവകാശം പ്രകാരമുള്ള പൗരത്വം) അല്ല. അതേ സമയം മതം, വംശം, ജാതി,ലിംഗം, ജന്മസ്ഥലം എന്നിവയിലൊ ന്നിന്റെ അടിസ്ഥാനത്തിൽ ഒരു പൗരനോടും ഭരണകൂടം വിവേചനം കാട്ടരുതെന്ന് ഭരണഘടനയുടെ ആർട്ടിക്കിൾ 15 വ്യക്തമാക്കുന്നുണ്ട്.

അനധികൃത കുടിയേറ്റക്കാരെ, നുഴഞ്ഞുകയറ്റക്കാരെ തിരിച്ചറിയുന്നതിനായി ഇന്ത്യയിലെ എല്ലാ നിയമപരമായ പൗരന്മാരെയും രേഖപ്പെടുത്തുക എന്നതാണ് 1955-ലെ പൗരത്വ നിയമത്തിന്റെ 2003 ഭേദഗതി പ്രകാരം സൃ ഷ്ടിക്കപ്പെട്ട നാഷണൽ രജിസ്റ്റർ ഓഫ് സിറ്റിസൺസ് (എൻആർസി).
ദേശീയ ജനസംഖ്യാ രജിസ്റ്റർ:
&nbsp;2021 ലെ സെൻസസിന്റെ ഭാഗമായി എൻ.പി.ആർ തയ്യാറാക്കാൻ കേന്ദ്രം തീരുമാനിച്ചിരുന്നു. ഇതിനെതി രെയും കേരളമുൾപ്പെടെ പല സംസ്ഥാനങ്ങളും മുന്നോട്ട് വന്നിരുന്നു. എൻ.പി.ആറിനായി ശേഖരിക്കുന്ന വിവരങ്ങളുടെ അടിസ്ഥാനത്തിൽ എൻ.ആർ.സി തയ്യാറാക്കു കയാണ് കേന്ദ നയം.
പൗരത്വത്തിന് മതം മാനദണ്ഡമാകുന്നത് ഭരണഘട നാവിരുദ്ധമാണ്. പുതിയ ഭേദഗതി നിയമം പ്രായോഗി കതലത്തിൽ കേരളത്തെ ബാധിക്കില്ലെങ്കിലും രാഷ്ട്രീയ പ്രത്യാഘാതങ്ങൾ ഏറെയാണ്. പൗരത്വ നിയമത്തി ലെ വിവാദ വ്യവസ്ഥകൾക്കെതിരെ ആദ്യം പ്രമേയം പാസ്സാക്കിയ നിയമസഭ കേരളത്തിലേതാണ്. സുപ്രീം കോടതിയെ സമീപിക്കുകയും ചെയ്തു. കേരളത്തിന്&nbsp;പിന്നാലെ പഞ്ചാബ്, രാജസ്ഥാൻ, പശ്ചിമ ബംഗാൾ, മധ്യപ്രദേശ്, തെലങ്കാന സംസ്ഥാന നിയമസഭകളും പ്രമേയം പാസ്സാക്കി തങ്ങളുടെ ശക്തമായ എതിർപ്പ് വെളിപ്പെടുത്തിയിരുന്നു. സി.എ.എയെ ചോദ്യം ചെയ്യുന്ന ഏകദേശം 250 ഹർജികൾ ഇപ്പോൾ സുപ്രീം കോടതി യുടെ മുന്നിലുണ്ട്. പുതിയ പോർമുഖം തുറക്കുമ്പോൾ ഇതിലെ നൂലാമാലകൾ ഇഴപിരിച്ചെടുക്കേണ്ട കടമയും ബാധ്യതയും കേന്ദ്ര സർക്കിന് തന്നെ. തുല്യനീതി രാഷ്ട്രത്തിന്റെ യശസ്സുയർത്തും. ജനങ്ങളുടെ സന്തുഷ്ടി രാഷ്ട്ര നന്മയ്ക്ക് ഗുണം ചെയ്യും. വിവേചനം നമ്മുടെ ശിരസ്സ് താഴ്ത്തിക്കും. രാജ്യമെങ്ങും അസന്തുഷ്ടിയുടെ ചുടു കാറ്റ് വീശും. അത് നമുക്ക് വേണ്ട എന്ന തീരുമാനമെടുക്കുമ്പോൾ നാമെല്ലം ഇന്ത്യക്കാരും സഹോദരന്മാരുമാകും.
